Terms and Conditions - To Bid and Buy REGISTRATION & IDENTIFICATION: At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. All bidders must be of legal age to bid. PAYING FOR YOUR PURCHASES: There is no cost to register for an auction. After an auction closes, you will receive an invoice showing the winning bid amount(s), plus applicable Buyers Premium and taxes, as stated in terms of auction. We will charge your credit card with up to $500 with the balance to be paid by cash or etransfer (payable to info@ruslands.com). US bidders must pay the remaining balance by money order or wire transfer, subject to banking fees as applicable. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with all faults. **Winning bids can be viewed in your profile under the PAST BIDS LIST in your profile** BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. WINNING NOTIFICATION & INVOICING: All winning bidders will receive an e-mail invoice shortly after the auction closing. **Your winning bids can be viewed in your profile under the PAST BIDS LIST, however, if you DO NOT RECEIVE an invoice and you think you are a winner or have won, please notify the office, (705)745-4115 or email info@ruslands.com and we will resend an invoice. BUYER'S PREMIUM: All purchases are subject to a buyer's premium, unless otherwise noted. The rate is 13% for Canadian bidders, and 18% for US bidders. PICKUPS & REMOVALS: Dates and times for pickup will be posted on our website. Any item not picked up during the posted pickup times will be considered an abandoned item. Items are sold as is, where is, with all faults. If you abandon an item, your credit card will be charged for the purchase price of the item plus the cost to remove, transport and dispose the item. If Rusland's decides to resell an abandoned item, the buyer will be subject to a 25% restocking fee. CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item during the scheduled preview times. No responsibility is assumed by Rusland's or the seller for any errors or omissions. CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults. PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. All bidders/buyers must be of legal age. RESERVE: Seldom are items sold with Reserve. If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to win the item. AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. SOFT CLOSE: Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 3 minutes. This will continue until all bidding has ceased. STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults. Rusland's reserves the right to process the credit card that you registered with for any delivery fees, disposal, storage, shippinge, or any other services provided by Rusland's. SHIPPING Pick Up Fee, Handling and Shipping Charges may apply. -Transport of Auction Items from Auction Location (when applicable), incurs a fee. -Transport to Shipping Company, incurs a fee Rusland's has partnered with Package Plus, a local third party shipping company, for packing & shipping. Extra packaging costs will apply for multiple and larger items, such as artwork. Shipping costs by shipping company (Canada Post, UPS, FedEx, etc) are extra. We ship across Canada and the US. Shipping must be arranged during the allotted pickup time, otherwise items will be considered abandoned and will qualify under abandoned items as stated earlier in our terms and conditions. Once shipping has been requested, all handling & preparation charges will be processed on the credit card with which you registered. Please note: You may see 2 separate charges on your credit card. One for the items won in the auction, the second for handling & preparation of your items for the shipper. Package Plus will contact you with a quote and you will pay them accordingly. We reserve the right to decide what can be shipped due to size and weight restrictions, fragility and value, etc. We will not ship any items containing liquids. We will deliver furniture within a local area, but we will not ship furniture. We will not ship items weighing over 50 lbs. Rusland's reserves the right to require a deposit prior to shipping. We are an auction company first, and offer shipping as an additional service. Please allow approximately 6-8 weeks for shipping. We follow Canada Post and other carrier guidelines. Neither Rusland’s nor any of the shipping companies will cover fragile items. We will not reimburse for items that have been damaged en route by the shipping company.
