BE SURE TO READ LOTS 1-1E!!!
1. Click on the auction information tab to find out where this Auction is being held from, when the preview is and when pick up dates are. ALL relevant information can be found in “AUCTION DETAILS” or LOTS 1-1Z. Our auctions are set up so no communication is required from start to finish including pick up.
2. A 15% Buyers Premium and 13% HST will be added to all invoices regardless of the items purchased. This includes books, kids items, food etc. Be sure to factor this into your bid.
3. Hibid does not notify us when you change your email address on your account. Please email us directly at online@403auction.com and we will update your account with us.
4. We DO NOT ship. Payment is made at the time of pick up so companies such as UPS cannot pick up for you as they will not pay on your behalf. Exceptions cannot be made. If you cannot pick up yourself or have a friend pick up for you, you should not bid
5. Our auctions are open to local residents only. A credit card associated with an Ontario address must be used to register. Registration is not accepted without a valid Ontario credit card
6. Customers who do not pick up during the allotted times will be billed a 25% restocking fee on the full invoice price (or $20, whichever is greater), items will NOT be held, and their account will be suspended. There will be a $25 admin fee to reinstate the account ($75 + the restocking fee if this is not the first missed pick up) Items WILL NOT be available for pick up after the posted times. NO EXCEPTIONS!!! YOU DO NOT NEED YOUR INVOICE TO BOOK AN APPOINTMENT TO PICK UP.
7. PAYMENT methods are Cash, Debit, Visa or Mastercard ONLY (credit cards must be present and pin entered. We WILL NOT not accept credit cards over the phone, online or enter them manually). ALL items must be picked up in one trip. Multiple trips are not permitted, please bring a vehicle large enough to fit all your purchases.
8. All communication is made through email only. We do not check phone messages so please email all inquiries.
9. Often bidding happens in the closing minutes so if you can, try to be on and watch the auction close. No streaming technology is perfect, so it is always a good practice to refresh your screen once in a while during the closing minutes. If you are not in the live catalogue (you see the seconds counting down in the live catalogue) ...you MUST refresh your screen or you will not have up to date information. Email is unreliable. You may not receive an outbid notification even if you have set your account to receive then.
10. Max bid is available to all bidders. This feature allows bidders to enter the highest bid they are willing to go on an item and the system will bid on their behalf. For example, Lot 25 is currently at $50. You enter a bid of $200. The system will bid $55 for you. The lot will stay at $55 until someone else bids $60. At that time, the system will bid $65 for you. This will continue until either no one else bids and you win, or your $200 is reached. Max bid is also the reason you may be outbid as soon as you enter a bid. If someone has a max bid entered, the system will bid for them every time you bid, until their max is reached.
11. In the event of a tie bid (2 bidders enter the same amount, it is always awarded to the first person who entered it.) So, you enter a bid of $100 and the current high bid is now $100 but it says you are outbid, that means someone else entered a $100 bid before you and the system recognizes them as the high bidder since they entered the bid first.
12. Our online auctions use a soft close that prevents auction sniping as it more accurately reflects the true auction process. In a real auction the bidding is over when the bidding stops and that is what the soft close does. If an item is scheduled to end at 8:15, and a bid comes in in the last 2 minutes, that item will be extended by 2 minutes to a 8:17 close time, this gives others time to react and enter another bid if they so desire. This continues until there is no bids in the last 2 minutes which signifies that all the bidders are done and the auction ends. In a live auction this is similar to the going once twice, fair notice...Sold!
13. “STATUS” at the end of the auction: If you log into your account you will either see "STATUS" WHICH MEANS YOU WON....or "Outbid" which means you lost. This is just how the system works but know that "STATUS" means you Won......PERIOD!
14. We send out email notifications and invoices the day after the auction. Email is incredibly unreliable and emails with attachments get blocked, flagged, directed to junk folders and many other things all the time. It is your responsibility to check your account to see if you won and attend during the pick up times as posted in the auction details (With ID). We have no way of knowing whether you received our emails or not and they rarely come back undeliverable. Hotmail, Live, and Sympatico are notoriously brutal for blocking emails. Stating you did not receive an email will not exempt you from late fees so please check your account.
15. All items are sold AS IS regardless of how they are described or what is shown in photos, however 403Auction my return an item at our discretion if there is an error in the listing. To be considered for a return, customers must email online@403auction.com and the item must be returned within 24hours of picking up. If approved, the item MUST be returned to the stated location by appointment only, within 24 hours of picking up. 403Auction WILL NOT return an item after 24 hours of pick up. There will be NO EXCEPTION to this. This includes phones, large items and items that need to be assembled. If the item is returned during the active pick up hours (as posted) the refund will be processed back to the method of payment used to purchase. If the item is returned outside the posted pick up hours, there will not be a cashier available and the refund will be AUCTION CREDIT ONLY. Customers who do not want auction credit MUST check their items before leaving the parking lot!!! Customers who are unable to return in the stated time frame or live too far away to make another trip must inspect their items THOROUGHLY before leaving the building when picking up to avoid having to make another trip. In the event pick up is held at an offsite location, an item is returned outside posted pick up hours and we are no longer at that location; the item may have to be returned to our Westcreek location. This will be determined by 403Auction when approving the return.
16. When you are logged in, at the top of the top of the page by the 403 AUCTION you will see coloured buttons with numbers in them...this is a snap shot of your bidding. Green is how many auctions you are winning, Red is how many you have been outbid on and Blue is how many you are watching. By clicking on any of those buttons you can see which items you’re winning, losing or watching and even bid from those screens. Keep in mind those screens are not live feeds so you need to refresh them every minute or so as an auction is closing to have up to date info in the closing seconds of an auction.
17. Certificates with jewellery are for information purposes regarding the details of the items such as gold content, type of gemstone, size etc. Values shown are either MSRPs or insurance values which are considerably higher than market values. Buyers should shop around and do their due diligence regarding current market value of any item. We will not return an item because another appraiser gives you a different appraisal. These certificates are NOT appraisals and regardless of the amount on the certificate, we will not return the item. Be sure to inspect the jewellery and bid according to your own judgement. Any prices included with any items, jewellery or otherwise, are MSRP or estimates only. You should do your research on the value of an item before bidding.
18. REGARDING FILM SALES: COA, CHARACTER OR SCENE REFERENCES: No COA's will be provided for any items. IF the sale is a film sale, studio authorized auction and items come direct to 403 from the studio. All items in this sale are items from the production company . 403 Auction, nor the studio make any guarantees or representations that any item was screen used. Due to the very nature of film productions and the filming process, some items may have back ups or duplicates and we have no way of knowing 100 percent the history of an item. Anywhere an item is described as a characters or from a particular sale, we are providing the best available information provided to us based on markings or indicators on the items. However again we make no guarantees that any item regardless of where it was meant to be used or who was intended to use or wear it, was actually used by that character. By registering, bidders agree to do their own due diligence and ultimately determine to their own satisfaction the likeliness an item was screen used.
19. Any Measurements posted are approximates only and no guarantees are made regarding measurements. No Adjustments will be made due to an error in measurements. If the exact size of an item is important to you, you should attend preview and measure it to your own satisfaction.
20. Colors may be different than they appear. Studio lighting is extremely poor and a combination of poor lighting and camera flashes as well as different computer screen settings can alter colors, blacks can look brown, browns can look black etc.. All items are sold AS IS where is and we offer a preview so that you can determine all the details meet your satisfaction. If you do not attend preview you accept all items as they are. Clothing items may have been tailored to better fit an individual actor. Again, we offer preview for you to inspect items and no adjustments will be made if an item has been altered. **As with all film set sales these items are used items during production and with that can be wear and tear. Preview is highly recommended to inspect items to your satisfaction. All Items are sold AS IS where is with all faults. ****
21. By registering you agree to receive emails sent to registered bidders for the length of auction including pick-up and any sequels to the registered auction. These emails cannot be "unsubscribed" from. You can unsubscribe from any other emails by clicking on the link at the bottom of the email.
22. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question and that all other items bid on remain binding. Items approved for a refund are returned at the buyers expense. IT IS THE BUYERS RESPONSIBILITY TO CHECK THEIR ITEMS BEFORE LEAVING THE PARKING LOT.
23. LIMITATION OF LIABILITY You expressly understand and agree that Principal Liquidators Inc and it's Consignors shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. These terms and conditions are in accordance with and governed by the laws of the Province of Ontario. Any legal matters will be settled in Ontario only, according to the laws governed by the Province of Ontario.
24. SITE OUTAGE: In the event of a outage that affects bidding at any time during the closing on a sale, 403 Auction at our discretion may extend the auction in it's entirety or in part (including lots that may have already closed) for a period of up to 24 hours. This decision will be made based on the severity of the outage. Previously closed items may be extended as there is no 100% way to determine that they closed prior to the outage and that all bidders who intended to bid were able to bid . This is an extremely rare occurrence but in the event that it happens we need to be fair to all bidders (including those who may not have been able to bid) as well as our consignors.
25. BUYERS: The BUYER expressly agrees to indemnify and save Principal Liquidators Inc., the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Principal Liquidators Inc., or anyone acting in his/her behalf in connection with or arising out of auction. All bidders/buyers must be of legal age.
